Processing of personal data
As part of the use of the Fidere Avocats website (hereinafter referred to as the ‘Site’), the user (hereinafter referred to as the ‘User’) may be required to provide Fidere Avocats (hereinafter referred to as ‘Fidere Avocats’) with personal data through the use of the contact form. The data controller in this regard is Geoffroy de Raincourt, Associate Lawyer. Any use of the site, and in particular any use of the contact form, implies acceptance of this paragraph regarding the processing of personal data (hereinafter the ‘Privacy Policy’).
The mandatory fields are indicated in the contact form. Fidere Avocats, as the data controller, commits to ensuring that the collection and processing of the User’s personal data are conducted in a lawful, fair, and transparent manner, in accordance with the General Data Protection Regulation (EU) (‘GDPR’) and the French Data Protection Act of 1978, as amended (‘LIL’).
This data collection is limited to what is necessary for processing the request, in accordance with the data minimization principle. The definitions provided in Article 4 of the GDPR are applicable to these terms.
Purpose
The Privacy Policy defines the rules applicable to the collection and processing of the User’s personal data during their navigation on the Site and use of the contact form. Fidere Avocats is free to modify the Privacy Policy at any time, particularly to take into account any legislative, regulatory, judicial, or technical changes. Identity and contact details of the data controller
The data controller for the personal data that the User provides during registration on the Site or throughout the navigation process is NAME OF THE SITE CONTACT PERSON, THEIR POSITION.
Legal basis for processing
The legal basis for processing is Article 6(1)(a) of the GDPR, which is the User’s consent. Indeed, when using the contact form, the User consents to the collection of their personal data by ticking the online checkbox accepting the Privacy Policy included in the legal notices of the Site, which they acknowledge having read.
Personal data collected
Data provided by the User to Fidere Avocats:
By submitting a contact form, the User provides Fidere Avocats with their first name, last name, and an email address so that their request can be processed. The User agrees, when using the contact form and the Site, not to disclose personal information, including personal data of third parties without their consent, nor to make illegal statements or post illegal content, including counterfeit, defamatory, abusive, insulting, obscene, offensive, discriminatory, violent, xenophobic content, or content inciting racial hatred or promoting terrorism; or any other content contrary to applicable laws and regulations, as well as to public morals and decency rules.
Purposes of the processing
The personal data collected from the User is intended for the purpose of processing the request submitted through the contact form.
Retention period of the personal data provided by the user
Fidere Avocats commits to retaining the personal data provided by the User only for the period strictly necessary for processing according to the aforementioned purposes, and in any case, within the limits imposed by law. Depending on the type of personal data, the retention period shall not exceed 12 months. Fidere Avocats commits to deleting the User’s personal data from the Site’s databases once the aforementioned retention periods have expired.
Recipients of personal data
The recipients of the User’s personal data are the staff involved in the management of Fidere Avocats, namely: the Fidere Avocats teams, including its commercial and administrative department.
Recipients of personal data
The User’s personal data is for the internal use of the services of Fidere Avocats. It is strictly confidential and cannot be disclosed to third parties, unless the User gives express consent or has chosen to make it public. In the event that the User’s personal data is shared with a third party, regardless of its nature, Fidere Avocats will ensure beforehand that the third party is bound by confidentiality obligations that provide at least the same level of protection as its own.
Fidere Avocats commits to: :
- (i) ensuring that any subcontractor provides sufficient and appropriate contractual guarantees to respect the User’s rights, so that the processing complies with the requirements of the GDPR, and
- (ii) complying with the provisions of the GDPR applicable to data transfers. Based on legal obligations, the User’s personal data may be disclosed in accordance with a law, regulation, or a decision by a competent regulatory or judicial authority.
Security of personal data
Fidere Avocats implements all necessary technical and organizational measures to ensure the security and compliance of personal data processing, as well as the confidentiality of such data. In this regard, Fidere Avocats takes all appropriate precautions on the Site (including data encryption), considering the nature of the data and the risks posed by the Site, to safeguard the security of the data and, in particular, to prevent it from being altered, damaged, or accessed by unauthorized third parties.
User rights
According to the applicable European regulations, the User has the following rights: right of access (Article 15 of the GDPR), right to rectification, updating, and completion of their data (Article 16 of the GDPR), right to erasure of their data under the conditions set out in Article 17 of the GDPR. Exercising the right to erasure of data by the User will result in the deletion of their account and any submitted applications. Right to restrict the processing of their data (Article 18 of the GDPR), right to data portability of the data they have provided (Article 20 of the GDPR).

In this case, the User must specify which data is concerned by their request and provide proof of identity (by submitting a copy of an identity document). Furthermore, as soon as Fidere Avocats becomes aware of the death of a User, it commits to deleting their data, unless its retention is necessary to comply with a legal obligation. If the User believes, after contacting Fidere Avocats, that their rights regarding their data have not been respected, they may file a complaint with the CNIL.
